What does Nest check before a message in the approval queue is approved?

Before a client-facing message can be approved, Nest checks the license, line-of-business and carrier appointment records you entered for the client's state. If a record is missing, approval is denied. The check is designed to fail closed: a missing input or a read error denies approval. It checks the records you entered. It does not verify your licensure, and it does not determine suitability or best interest.

How does Nest handle NAIC #613 / NY Reg 60 replacement rules?

Accepted Answer

A message tied to a replacing transaction - a 1035 exchange, surrender, rebook, or replacing reallocation - cannot be approved in the approval queue until a signed replacement notice record exists for that transaction, scoped to your organization. The check depends on the data you enter and does not detect every replacement. It checks that a record exists, not that a notice is sufficient. This is not legal advice; your counsel reviews your process, and you remain responsible for replacement compliance.

What happens when a client unsubscribes?

An unsubscribe writes an active suppression that Nest matches across your organization's sends. Outbound email consults the suppression ledger before it sends, and the check is designed to fail closed: if the ledger cannot be read, the message is treated as suppressed and withheld. You remain the sender under CAN-SPAM and state email laws.

Question 4

Does Nest make suitability or best-interest decisions?

Accepted Answer

No. A best-interest recommendation under Reg BI, and under the state best-interest model for annuities, is a judgment a licensed person makes about a specific client. Nest does not make, review or approve recommendations, and it is not a broker-dealer, investment adviser or insurance producer. AI drafts require your review and approval. You are responsible for suitability, best interest, replacement and advertising compliance.

Does Nest use AI to call or message clients on its own?

Accepted Answer

No AI places calls, and Nest has no AI voice. AI drafts are starting points that you review and approve. Automations you explicitly turn on send the templates you configured, and you are responsible for what they send. AI in Nest is an advisor-side drafting helper, not an actor that contacts your clients on its own.

Can these checks be turned off, and what is the default?

The checks run in the send path and are designed to deny on uncertainty. A kill-switch sits over the outbound path and shadow drafts are messages that can never send. Nest is software and the checks assist your documentation process; they are not legal advice and not a substitute for your own compliance program. Your counsel owns the policy.
